1 Services Provided

Pitbull Process Service provides professional legal document services including, but not limited to:

  • Process serving (personal and substitutional service)
  • Court filing services
  • Skip tracing and locate services
  • Secure document courier services
  • Residential and commercial occupancy checks

All services are performed in accordance with applicable Alberta laws, court rules, and professional standards.

2 Client Responsibilities

When engaging our services, you agree to:

  • Provide accurate, complete, and current information necessary for service completion
  • Ensure all documents provided to us are legally valid and properly prepared
  • Pay all fees in accordance with the agreed-upon payment terms
  • Comply with all applicable laws and regulations
  • Not use our services for any unlawful or fraudulent purposes
  • Notify us immediately of any changes to service instructions or contact information

3 Fees and Payment

Service fees are determined based on the type of service, urgency, location, and complexity. Payment terms include:

  • Fees must be paid before or upon completion of services unless otherwise agreed in writing
  • Rush or emergency services may incur additional charges
  • Court filing fees, mileage, and other disbursements are billed separately
  • Invoices not paid within 30 days may incur late payment fees
  • We reserve the right to suspend services for accounts with outstanding balances

4 Service Completion and Attempts

While we make every reasonable effort to complete service successfully, we cannot guarantee service completion due to factors beyond our control, including:

  • Inaccurate or incomplete information provided
  • Subject's evasion or refusal to accept service
  • Inaccessible locations or dangerous conditions
  • Legal restrictions or court limitations

Fees for attempted service are non-refundable. Multiple service attempts may incur additional charges.

5 Limitation of Liability

To the fullest extent permitted by law:

  • Pitbull Process Service's liability is limited to the fees paid for the specific service in question
  • We are not liable for any indirect, incidental, consequential, or punitive damages
  • We are not responsible for delays caused by factors beyond our reasonable control
  • We are not liable for errors in documents provided by clients
  • Our maximum aggregate liability shall not exceed the total fees paid by the client in the preceding 12 months

6 Confidentiality

We maintain strict confidentiality regarding all client information and documents. However, we may disclose information when:

  • Required by law, court order, or legal process
  • Necessary to complete the requested services
  • Authorized by the client in writing
  • Necessary to protect our legal rights or defend against claims

7 Cancellation and Refunds

Cancellation policies:

  • Services may be cancelled before work begins for a full refund
  • Once service attempts have commenced, cancellation fees may apply
  • No refunds are provided for completed services or unsuccessful service attempts
  • Cancellations must be submitted in writing via email or phone

8 Indemnification

You agree to indemnify, defend, and hold harmless Pitbull Process Service, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms of Service
  • Your violation of any law or the rights of a third party
  • Inaccurate or false information you provide
  • Your misuse of our services

9 Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Any disputes arising from these terms or our services shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation fails
  • Litigation in the courts of Alberta if mediation is unsuccessful

10 Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms. Material changes will be communicated to active clients via email.
